Terms of Service

By signing up for an account, embedding our SDK or widget, or calling our APIs, you agree to these Terms and our Privacy Policy. If you are using Thaliq on behalf of an organization, you represent that you have authority to bind that organization. If you do not have that authority, do not use the service.

Thaliq provides infrastructure to build, deploy and operate AI agents — multi-model routing, MCP gateway, RAG, human-in-the-loop and observability — exposed via SDK, REST API, widget and channel integrations.

We may modify, add or remove features at any time. For material changes that reduce functionality of a paid plan, we will give 30 days notice.

• You are responsible for the security of your account credentials and API keys. Rotate them if compromised.
• You are responsible for all activity under your account, including by users you invite.
• You must provide accurate information when registering, and keep it up to date.
• You must be 16 or older to create an account.

You agree not to use the service to:

• Violate any law, regulation or third-party right.
• Build agents that impersonate humans without disclosure, defraud users, or facilitate harassment, hate speech or sexual exploitation.
• Generate or distribute malware, spam, phishing content or content that infringes intellectual property.
• Reverse engineer the service, attempt to bypass plan limits, or access data that does not belong to your tenant.
• Resell, sublicense or relabel the service except as expressly permitted by your plan (e.g. white-label on Enterprise).
• Overload the service to the point of degradation for other customers.

We may suspend or terminate accounts that violate this section, with notice when possible and immediately when required to protect the service or other customers.

You retain ownership of the data you upload, the prompts you write, the agent specifications you configure, and the outputs generated for you. We do not claim ownership over any of it.

You grant us a limited license to host, process and transmit your content for the sole purpose of providing the service to you. We do not use your content to train general-purpose AI models, and we do not share it with other customers.

You are responsible for ensuring that you have the rights to upload, process and use the data you put into the service — including consent from the end users whose data you process through your agents.

Thaliq, our brand, our product, our APIs and our documentation are protected by intellectual property laws and remain our property. Nothing in these Terms grants you any right or license to our intellectual property except the limited right to use the service per your plan.

If you provide feedback, suggestions or ideas about the service, we may use them without obligation or compensation. Sending feedback is voluntary.

We offer free and paid plans. Paid plans are billed monthly or annually in advance, in the currency listed on the pricing page. Usage above plan quotas is billed at the rates published on the pricing page.

• Payments are non-refundable except where required by law.
• We may change pricing with at least 30 days notice for renewals. Prices for the current billing period are locked.
• Failed payments may result in suspension of the service after we give you reasonable notice to resolve.
• You are responsible for any taxes applicable to your use of the service that are not collected by us.

You can terminate your account at any time from the product settings. We may terminate or suspend your access for material breach of these Terms, with notice when possible.

On termination: your access ends, your data is retained for 30 days and then deleted, and any unpaid fees become due. Sections that by their nature should survive (IP, liability, indemnification, governing law) survive termination.

The service is provided "as is" and "as available", without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, non-infringement, or any warranty regarding the accuracy or reliability of AI-generated outputs.

AI models can produce inaccurate, biased or harmful content. You are responsible for reviewing outputs before acting on them, especially for decisions that affect users, money or compliance. Do not rely on AI outputs for medical, legal, financial or safety-critical decisions without human review.

To the maximum extent permitted by law, Thaliq's total liability for any claim arising out of or relating to the service is limited to the fees you paid in the 12 months preceding the event giving rise to the claim, or USD 100, whichever is greater.

We are not liable for indirect, incidental, consequential, special or punitive damages — including lost profits, lost revenue, lost data or business interruption — even if advised of the possibility.

Some jurisdictions do not allow these limitations; in those cases, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify and hold harmless Thaliq, its affiliates and personnel from any claim, demand or liability arising from your use of the service, your content, your violation of these Terms, or your violation of any law or third-party right.

We may update these Terms from time to time. For material changes, we will notify you by email at least 30 days before the change takes effect. Continuing to use the service after the effective date constitutes acceptance.

These Terms are governed by the laws of [Ley aplicable pendiente — completar], without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms will be resolved in the competent courts of [Jurisdicción pendiente — completar].

For customers in jurisdictions where consumer-protection rules grant additional rights, those rights are not affected by this clause.
